NEVELE RESORT PAYS ULSTER COUNTY IN FULL FOR OUTSTANDING TAXES AND PAYMENTS IN LIEU OF TAXES

Kingston, NY (September 30, 2009) - In late August 2009, Ulster County filed a lawsuit in New York State Supreme Court against Nevele, LLC to ensure that all claims by the County for outstanding payments in lieu of taxes (PILOT) and other unpaid taxes were satisfied before the closing of any auction sale of its property.

On September 2, 2009, the Honorable Richard Platkin, Acting Justice of the New York State Supreme Court, Third Judicial District, ruled in favor of Ulster County and signed an Order of Attachment against Nevele’s property.

In response to the Supreme Court Order, Ulster County has received payment via wire transfer from Nevele Hotel, LLC, in the amount of $342,687.22.This sum satisfies all general county taxes, town taxes and hotel/motel taxes owed by Nevele for the years 2008 and 2009, plus interest and full reimbursement for the County’s litigation costs and attorneys’ fees.

“First of all, I would like to recognize the outstanding efforts of our County Attorney, Bea Havraneck and our Special Counsel, Keane and Beane, LLC for shepherding this matter through the legal process and bringing it to a successful conclusion. It’s a real win for taxpayers,” said County Executive Mike Hein. He added, “Now that this matter is closed, we look forward to working with the new owners of the Nevele to restore and create good job opportunities in the Ellenville area. I would also like to thank our County Comptroller, Elliot Aeurbach for focusing his attention on helping to resolve this issue.”
